Media Consent and Release Form

Agreement

1. These are the terms and conditions (the “Terms”) which govern the use of your photographs, digital images, audio, video footage and/or any other recording (the “Images”) by Teach Me About Property Pty Ltd (ABN 82 616 550 264) (“TMAP”).

2. You should always check these Terms every time you visit the Site as TMAP may make changes to it from time to time without letting you know.

3. Once you have accepted these Terms by clicking the “I have read, and agree to, the TMAP Media Consent and Release Form” (or other similar wording), you waive any right you may have to assert that the fact that you indicating your acceptance of these Terms electronically does not constitute actual acceptance.

Consent

1. You hereby consent for TMAP to:

- Take, or have taken by others, the Images and
- publish the Images in any form, in whole or in part, and distribute them in any medium including, but not limited to, print media, the internet, TMAP social media accounts, other multi-media uses, advertisements or graphic representation in connection with TMAP’s business.

2. To the extent that the Images contain another person who is:

- under the age of 18, you consent to the use of their Images in accordance with this form and warrant that you are the parent or guardian of that child; and/or
- over the age of 18, you confirm and warrant that they have consented to the use of their Images in accordance with this form.

Waiver and acknowledgements

1. You acknowledge and agree that the Images are the absolute property, and remain in the ownership, of TMAP.

2. You confirm that neither you nor any other person in the Images will be paid for giving this permission and you hereby waive any claim that you may have had for any remuneration, residuals, royalties or any other payment in respect of use of the Images.

3. You cannot make any claim (of any nature) against, and hereby discharge, TMAP in connection with the use of the Images in accordance with this form.

4. TMAP is not responsible for any loss, damage or expense, howsoever arising, whether direct or indirect and/or whether present, unascertained, future, contingent or consequential (including but not limited to any loss or damage arising from a breach of contract or agreement, tort, or any other basis in law or equity including, but without limitation to, loss of profits, loss of revenue, loss of production, loss or denial of opportunity, loss of goodwill, indirect or remote or unforeseeable loss, loss of reputation, future reputation or publicity, or any similar loss which was not contemplated by the parties) (Liability) suffered by you or any third party, arising from or in connection with the Images.

5. To the fullest extent permitted by law, the liability of TMAP is limited to $1.00.
